All visitors of this site, whether they are authorized users or Vendors are bound by the agreements in the Terms & Conditions and Privacy Policy. This information is available by clicking the appropriate links.

Vendors agree that no unauthorized auto responding is allowed on this service. Responses are to be answered in an individual manner. Any of the information disclosed on this service is not permitted to be forwarded or sold, as they are exclusive to paid, active Vendors only. DiamondFetch.com does not tolerate the collection of Email Addresses for the use of spam.

Visitors of this site agree to be of legal age, over 18 years old. If visitors are under 18 years of age, they agree to have parental permission to visit and/or use the services available on this site. Parents of underage users agree to their minor’s use and agree to these Terms & Conditions.

All visitors agree to disclose truthful information in regards to contact information, payment information, and/or any other type of information exchange used on this site. All visitors agree that payment transactions are done in good faith and agreement to these terms. Visitors agree that any fraudulent activity is subject to prosecution and investigation by the appropriate agencies. Delinquent payments are subject to the terms outlined in payment schedules upon vendor registration.

Visitors agree that all information, content, and materials specific of this site are property of DiamondFetch.com,(A COMsource, Inc. Company) and that any copying of this information is in violation of the law. The use of this site’s materials, products, or service is not to be used to violate the law.

Since DiamondFetch.com is not involved in the actual transaction between Sellers and Buyers, DiamondFetch.com will not be involved in the resolution of any disputes that may arise. DiamondFetch.com is released from any and all claims, damages, and demands involved with such disputes.

Visitors agree as per the Terms & Conditions to not disclose personal information, such as passwords to others for use of this service. DiamondFetch.com is licensed to receive and use information that is disclosed through this service.

DiamondFetch.com does not provide any warranties for any actions or services beyond what is offered on this site.

DiamondFetch.com waives legal warranties implied by law under the Uniform Commercial Code.

DEFINITION OF ROLES
Role Agreements:

User :
The term “User” refers to a person or persons who access this service in the capacity and intent of submitting requests for an unlimited amount of free jewlry, diamond or diamond jewelry information and/or availability Requests to be viewed by all active and authorized vendors. Users acknowledge that all Requests contain valid information to the best of the user’s knowledge and are submitted upon serious intent of receiving sales opportunities from authorized Vendors of this service. If a user submits Requests with the intent of misuse of this service, appropriate action will be taken against such user. A user may consist of a person or persons from the following, but not limited to: general public, insurance companies, jewelers, diamond retailer, diamond wholesalers. All users who submit a Request are required to complete certain fields or submit certain information as outlined in the Request Page or requested by a DiamondFetch.com representitive. Users are protected by the Privacy Policy, which guards against misuse of personal information. DiamondFetch.com is not, however, responsible for disputes that may occur between users and Vendors, as DiamondFetch.com is not involved with actual sales. Functioning as a user, individuals understand that This service operates as an information exchange linking users’ Requests with Vendors. The actual sale of jewelry, diamonds or diamond jewelry are performed outside of the capacity of this site. Users agree that this service serves as an “as is” basis and is not responsible for transactions between users and vendors outside of the capacity of this site.

Vendor :
The terms “jewelers, diamond retailers or diamond wholsalers" refered to as "Vendors" refers to a person or persons who pay the rate of fee for service as outlined in the Vendor Registration Page and any other notifications of increase such fees. Vendors will be receive expressed, written notification of any increases in subscription fees. As an active vendor of DiamondFetch.com, vendors agree to pay all applicable charges following the Terms & Conditions agreement and/or the at the rate of payment as selected by the vendor. Vendor subscriptions will continue and renew automatically unless terminated by DiamondFetch.com or until vendors notify DiamondFetch.com of a decision to change the subscription renewal. If there are any annual, monthly or similar periodic fees for vendor subscription, these fees will be billed automatically to the credit card designated during the registration process for DiamondFetch.com at the start of the subscription period and at the start of each renewal period, unless vendors terminate the subscription before the relevant period begins. Vendors agree to pay or have paid all fees and charges incurred in connection with the subscription for DiamondFetch.com (including any applicable taxes) at the rates in effect when the charges were incurred. All fees and charges for DiamondFetch.com service are nonrefundable. DiamondFetch.com may change the fees and charges then in effect, or add new fees or charges, by giving vendors notice in advance. All fees and charges incurred in connection with vendors' account names and passwords will be billed to the credit card designated during the registration process for DiamondFetch.com. Vendors also are responsible for any fees or charges incurred to access DiamondFetch.com through an Internet access provider or other third party service. Vendors are responsible to cancel service independently, or subscription will be charged following the payment schedule selected. Vendors agree to make prompt payments, or otherwise are subject to late fees. Vendors who are delinquent with subscription payments are subject to suspension and/or termination of their active service and will be charged all applicable fees for any returned checks, declined credit cards, and/or any attorney fees if legal action is necessary. Vendors surrender the responsibility of DiamondFetch.com from any disputes or any other liabilities involving the sales to users from this service. DiamondFetch.com is not responsible for any costs, damages, lost wages, attorney fees, warranties, or other liabilities resulting in transactions or communications between users and vendors. Vendors agree that this service serves as an “as is” basis. VENDORS, AND NOT DiamondFetch.com, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO THEIR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY THE VENDOR. This Agreement is personal to vendors, and vendors may not assign vendor's rights or obligations to anyone.

Users and vendors are bound by the Terms & Conditions and Privacy Policy, and express sincere acceptance of these policies by using services offered by this site in particular and DiamondFetch.com in general. All content included on this site, such as text, graphics, layout, design, logos, etc. are the property of DiamondFetch.com, (A COMsource, Inc. Company) and exclusive content to DiamondFetch.com only.
